On October 1, 2024, the Ministry of Labor and Social Security - Directorate General of International Labor, announced new updates as follows:
- High-Sales Businesses:
- A significant change was made for businesses with a net sales amount exceeding 50 million TL. These companies will not need to comply with the local workforce ratio when employing up to five foreign workers. This is expected to provide a substantial advantage for large companies.
- Qualified Investors:
- Foreign investors with a capital share of $100,000 or more will benefit from an exemption from employment criteria. With this decision, Turkey aims to provide significant advantages for high-tech jobs and major investors.
- Tourism Sector:
- Important flexibilities have also been introduced, especially for the tourism and health tourism sectors. Foreigners working in jobs requiring expertise and craftsmanship in tourism will be exempt from the obligation to employ local workers, provided certain conditions are met.
- IT Sector:
- Recognizing the need for specialized foreign labor in the IT sector, the Ministry of Labor and Social Security has revised the employment and financial adequacy criteria for this sector. Foreigners working in IT companies will no longer be subject to employment and financial adequacy criteria.
- Ease in Household Services:
- Another significant aspect of the regulation focuses on the care economy. For jobs involving childcare, elder care, or patient companionship, employers can now include the income of family members as proof of financial capacity when hiring foreign workers, thanks to a sponsorship system.
- Turkey TechVisa Program:
- This program was designed to attract talent with critical expertise in technology to Turkey.
An additional goal of these regulations is to increase registered employment. Foreigners who have legally resided in Turkey for three out of the past five years will find it easier to meet employment and financial adequacy criteria. This aims to regularize the foreign workforce and create a more organized labor market.
